Acceptance of terms
By accessing or using Kissend (including kissend.com and app.kissend.com), you agree to these Terms of Use. If you do not agree, do not use the service.
We may update these terms from time to time. The “Last updated” date at the top will change when we do. Continued use after changes means you accept the revised terms.
Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use Kissend. If you use Kissend on behalf of an organization, you represent that you have authority to bind that organization.
Account
You are responsible for maintaining the confidentiality of your login credentials and for activity under your account. Choose a unique username and keep your authentication details secure.
Provide accurate information when creating an account. Notify us promptly at [email protected] if you suspect unauthorized access.
We may suspend or terminate accounts that violate these terms or that create risk for other users or the service.
Acceptable use
Kissend is a private web chat for lawful, consensual one-to-one messaging. Use the service respectfully and in accordance with applicable laws.
You agree to use connection requests and messaging features in good faith — do not harass, spam, or attempt to coerce others into conversations.
Prohibited uses
You may not use Kissend to engage in illegal activity; exploit, abuse, or harm others; distribute malware; attempt to break encryption or security controls; scrape the service; reverse engineer the product except where permitted by law; impersonate others; or send unsolicited bulk messages.
You may not use Kissend to violate privacy rights, commit fraud, or interfere with the normal operation of our infrastructure.
We may investigate and take action — including account suspension — when we reasonably believe prohibited use has occurred.
Intellectual property
Kissend, including its name, logos, design, and software, is owned by Kissend or its licensors. You receive a limited, non-exclusive, non-transferable right to use the service as provided.
You retain rights to content you send in chats, subject to the licenses needed for us to deliver the messaging service. Do not upload content that infringes others’ rights.
Disclaimer of warranties
Kissend is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee uninterrupted or error-free service. Features such as screenshot protection and disappearing messages reduce certain risks but cannot eliminate all ways content may be copied or remembered.
Limitation of liability
To the fullest extent permitted by law, Kissend and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from your use of the service.
Our aggregate liability for claims relating to the service will not exceed the greater of amounts you paid us (if any) in the twelve months before the claim or one hundred US dollars (USD $100), except where liability cannot be limited by law.
Termination
You may stop using Kissend at any time and may request account deletion by contacting us.
We may suspend or terminate access if you violate these terms, if required by law, or if we discontinue the service. Provisions that by nature should survive (including IP, disclaimers, and liability limits) will survive termination.
Changes to the service
We may modify, suspend, or discontinue features of Kissend as we improve private web chat. We will try to communicate material changes when practical.
Governing law
These terms are governed by the laws of the jurisdiction in which Kissend primarily operates, without regard to conflict-of-law principles, except where mandatory consumer protections in your country apply. Courts in that jurisdiction will have exclusive venue for disputes, subject to applicable consumer rights.
This governing-law clause is a placeholder-style provision until a specific corporate jurisdiction is published; contact us if you need a formal notice address for legal process.
